On November 7, the Ministry of Mines and Energy (MME) presented a proposal for the legal framework for Hydrogen in Brazil to the Energy Transition Working Group of the Sustainable Social Economic Council (CDESS), also known as “Conselhão.” The CDESS, initially created in 2003 and reestablished in 2023, serves as a platform for dialogue between the Federal Government and various social representatives, as outlined in Decree No. 11,454/2023.
The proposal is the result of discussions led by the Management Committee of the National Hydrogen Program (Coges-PNH2) over the last two months. It aims to regulate the Hydrogen certification process by establishing the Brazilian Hydrogen Certification System (SBCH2). The Bill also outlines the governance and structure of the bodies that will oversee the system and sets guidelines for the exploration and production of natural hydrogen in Brazil.
Establishing a legal framework for hydrogen is a key priority in the 2023-2025 Three-Year Plan of the National Hydrogen Program (PNH2).
